The Eviction Process

Step 1 - This first step in the eviction process is serving the tenant with a 5-day notice for nonpayment of rent. We strongly recommend that you use our downloadable form for several reasons. It complies with the Rhode Island Statutes. If you do not use a 5-day notice that complies with the Rhode Island Statues you could lose your case on this technicality. You may even have to start your case over and worse pay your tenants legal expenses.

Step 2 - This is where the entire fact gathering gets done, and it only takes a few minutes. EvictPros uses the information to create all of the forms needed to file a complaint for eviction.

Step 3 - EvictPros then files them with the court on your behalf, arranges for them to be served by the Sheriff, and sends a copy to both you and the tenant with your court date.

If you win a judgment and the court orders the tenant to vacate the premises and they do not, we will then file the rest of the forms to complete your case and execute the eviction.

If the same violation has occurred within prior 6 months a landlord can end a rental agreement with a 20-day written notice specifying breach and termination no allowance for time to make changes needed

If tenant has violated by using narcotics on premises or proven use on adjacent property, or similar use with controlled substances or crime of violence a landlord can file immediate eviction for failure to abide.
